TERMS & CONDITIONS – CASH FOR GOLD AND GOLD LOAN
1. Applicable legislation
CP Mining & Minerals Trading CC ("CP Minerals") is licensed under the Second Hand Goods Act of 1998 and the Minerals (Prospecting & Mining) Act of 1992.
CP Minerals offers to assess and purchase or accept as collateral your items (“Property”) on the terms and conditions set out below. By offering to sell any Property to us, you accept these terms and conditions.
3. Application of terms and conditions
These terms and conditions below are legally binding on you as a customer in relation to the potential assessment and sale or pledging of any Property which you present to CP Minerals.
4. Warrants by customer
You warrant to CP Minerals that:
- a. you are at least eighteen (18) years of age;
- b. you have good and marketable title to the Property;
- c. you are acting on your own behalf and not as the agent or representative of another person;
- d. the Property is sold free of all liens, encumbrances, liabilities, and adverse claims of any kind;
- e. the Property is not from, or the result of, illegal activity;
- f. any transaction initiated by you will not cause CP Minerals to be in violation of any laws or regulations;
- g. you are the actual legal owner of and have full authority to sell the Property to CP Minerals (we may, but shall not be required to, ask you to provide documentation or other proof of such ownership);
- h. on receipt of the agreed purchase price from CP Minerals all ownership will pass directly to CP Minerals.
5. Identification of customers
You will be required to provide a copy of a valid identification document, contact details, date of birth, nationality as well as any other information that we deem necessary with any Property presented to CP Minerals.
6. Method of payments to customers
All payments above N$ 300 (three hundred Namibian dollars) shall be made via bank transfer or other forms of electronic funds transfer. Lesser payments may be made in cash.
7. Single transaction limits
If a single transaction involves an amounts beyond N$ 2,500 (two thousand five hundred Namibian dollars) it will be subject to enhanced due diligence to determine the origin of the Property in order to rule out illegal activities.
8. Stolen goods and illegal activities
You agree that where we suspect any attempt to deal in any stolen goods including, but not limited to the items submitted to CP Minerals, we may report any relevant information to the Police and appropriate agencies forthwith.
9. Transaction monitoring
CP Minerals will monitor all transactions in order to identify unusual and potentially suspicious as well as transactions that are designed to circumvent the above requirements in Clauses 6 and 7.
10. Refining not resale
CP Minerals purchases precious metals such as second hand jewellery for refining, not for resale, however CP Minerals will have absolute discretion to resell the Property if it deems it appropriate to do so. Prices are based solely on the weight and carat grade in the Property upon testing by us, not on its potential value if resold intact.
11. Valuation of property
By presenting us with your Property, you accept that the process of determining a value may involve:
- a. placing certain acids on your Property and that this can leave permanent staining and/or deep scratches; and
- b. separating different materials or carat grades in the items included in your Property (including but not limited to watches and items containing different materials or carat grades, stones or non-precious materials). Such items may be destroyed and are not recoverable intact if you decide to reject our valuation of your Property.
12. Precious or semi-precious stones
Unless otherwise agreed by us with you, CP Minerals does not purchase precious or semi-precious stones; therefore, you are encouraged to remove any precious or semi-precious stones from your Property prior to presenting them to us. CP Minerals does not purchase costume jewellery or items not containing precious metals.
13. Limitation of liability
If in the unlikely event your items are damaged or lost whilst in our care prior to title being signed over to CP Minerals, we shall pay you 25% of the value of the items as supported by a sale or purchase receipts, up to the value of N$2500 (two thousand five hundred Namibian Dollars), being our total cumulative liability to you for all items lost. You hereby acknowledge, understand and agree that we shall not be liable for any loss, damage in excess of said N$2500 and hereby waive any and all claims for additional damages resulting from the loss or destruction of your Property.
14. Harzadous materials
You agree not to present to us any hazardous materials irrespective of how they are contained or presented especially those containing: Arsenic, Beryllium, Bismuth, Cadmium, Mercury, Nickel, Lead, Antimony, Selenium, Tin, Tellurium or any other toxic elements.
15. Customer information
CP Minerals does not disclose any personal information that you may have given us, such as name, address email etc, to any organization or person outside of CP Minerals and it associates. CP Minerals may, however, pass on personal information of customers to related companies of CP Minerals for marketing purposes. Under no circumstances will CP Minerals sell or receive payment for disclosing your personal information.
16. Information on website
Materials on our website may be generalized or summarized for the purpose of convenience, and may have details omitted that could be significant to particular persons, or in a particular context. Users of our website should verify the relevance of the information on the site for their own business or personal needs. It is not intended to be nor should it be relied on as a substitute for legal or other professional advice.
17. Links on website
Any link on our website to an external site is provided for your convenience only. CP Minerals does not control or monitor such sites, and is not responsible for the content or opinions that might be on them. We make no warranties or representations that material on other websites to which material is linked does not infringe the intellectual Property rights of any person anywhere in the world.
18. Internet security
While CP Minerals endeavors to provide a secure internet environment, users should note that there are inherent risks associated with transmission of information via the internet. CP Minerals provides alternate methods to obtain and provide information for those who do not wish to use public networks such as the internet. These include direct contact via telephone, facsimile or post. CP Minerals has implemented what is considered appropriate security features for our website but it and the underlying systems may be subject to attack from unauthorised persons.
19. Website availability
CP Minerals attempts to make our website available to users when required. However, CP Minerals cannot guarantee to provide continuous or uninterrupted access to our website. CP Minerals also cannot guarantee our website or software downloaded from it will be free from computer viruses.
CP Minerals’ failure to exercise or enforce any right or provision of these terms and conditions will not be deemed to be a waiver of such right or provision.
If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
22. Changes to terms and conditions -
We reserve the right to change these terms and conditions from time to time and advise you to visit our website, www.cpminerals.com, periodically to ensure that you are aware of our current terms and conditions. Additionally, we may announce on our website that our terms and conditions have been changed. You will be subject to the policies and terms and conditions in force at the time that you sell your Property to us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority.
23. Governing law
These terms and conditions shall be governed by Namibian law.
